These Terms of Service govern your use of the AMESS Creative website and your purchase of products or services from AMESS Creative. Throughout these Terms, “AMESS Creative,” “we,” “us,” and “our” refer to AMESS Creative and its operating business entity. “Customer,” “you,” and “your” refer to the person or organization using our website or purchasing from us.

By accessing our website, placing an order, approving a proof, subscribing to a service, or otherwise purchasing from AMESS Creative, you agree to these Terms of Service and all policies referenced within them.

Please review these Terms carefully before placing an order.

1. Eligibility

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order.

If you place an order on behalf of a business, organization, school, government agency, team, club, or another person, you confirm that you have authority to approve the purchase and agree to these Terms on their behalf.

You are responsible for providing accurate contact, billing, shipping, artwork, product and project information.

2. Products and Services

AMESS Creative provides custom printing, graphic design and related products and services. These may include:

• Custom stickers, decals and labels

• Banners, signs and displays

• DTF transfers and apparel printing

• Business cards, flyers, invitations and other printed materials

• Vehicle graphics and window graphics

• Custom graphic-design services

• Design-assistance subscriptions

• Other custom promotional and printed products

Because many products are individually designed or manufactured, the appearance, specifications, production process and turnaround time may vary by order.

We reserve the right to add, modify or discontinue products and services at any time.

3. Product Information

We make reasonable efforts to present accurate product descriptions, photographs, measurements, pricing, material information and availability.

However, website images are examples and may not represent the exact appearance of every finished product. Screen settings, lighting, materials, printing methods and manufacturing conditions may affect how colors, finishes and textures appear.

Unless expressly stated otherwise, dimensions and quantities may be subject to reasonable production tolerances customary for the applicable product.

4. Orders

Submitting an order does not guarantee acceptance. We may review an order before accepting or beginning work.

We reserve the right to reject, cancel or limit an order when:

• Required information is incomplete

• Artwork is unusable or inappropriate

• The requested work may infringe another person’s rights

• Pricing or product information contains an obvious error

• Materials or equipment are unavailable

• The order cannot reasonably be completed within the requested timeframe

• The customer has engaged in fraud, harassment, abuse or repeated policy violations

• The requested product or content violates the law or these Terms

If we cancel an order before providing products or services, amounts paid for the canceled portion will be refunded, less any authorized charges for work already completed when applicable.

5. Pricing and Payment

Prices are shown on the website or provided through a custom quote or invoice.

Prices may change without notice before an order is submitted. Once an order has been accepted and paid, the price will not ordinarily change unless the customer requests changes to the order or previously unknown requirements affect the work.

Additional charges may apply for:

• Graphic-design work

• Artwork rebuilding or correction

• Additional revisions

• Rush production

• Expedited shipping

• Specialty materials or finishes

• Changes requested after proof preparation

• Changes requested after approval

• Reshipping returned packages

• Work outside the original project scope

Payment must be received before production begins unless AMESS Creative has approved written payment terms for the customer.

Customers are responsible for applicable sales taxes and other legally required charges.

6. Custom Quotes

Custom quotes are based on the information available when the quote is prepared.

A quote may change if the customer changes the size, material, quantity, artwork, design, finish, installation requirements, shipping method, deadline or other project specifications.

Unless otherwise stated, quotes are valid for 14 days. A quote does not reserve production time or materials until the required payment has been received.

7. Proofs and Customer Approval

Some custom orders require a digital proof before production.

A proof is intended to show the general layout, text, placement, dimensions and design of the product. It may not display exact printed colors, material textures, finishes or final production characteristics.

The customer is responsible for carefully reviewing the proof before approval, including:

• Spelling and grammar

• Names, dates, phone numbers and addresses

• QR codes and website addresses

• Product size and quantity

• Artwork placement and orientation

• Image quality

• Colors and design elements

• Cut lines, borders and margins

• Material and finish selections

Approval may be provided through email, text message, the website, an approval platform or another written method accepted by AMESS Creative.

Once a proof is approved, the customer accepts responsibility for errors or design elements visible in the approved proof.

Changes requested after approval may require additional fees and may delay production. Once production begins, changes may not be possible.

8. Customer-Provided Artwork and Content

When you submit artwork, photographs, logos, text, trademarks, characters, designs or other content, you confirm that:

• You created the content or have permission to use it

• You have authority to reproduce it

• It does not infringe copyright, trademark, privacy, publicity or other rights

• It is not fraudulent, unlawful, threatening, defamatory or otherwise prohibited

• Producing the order will not violate any applicable law

AMESS Creative is not responsible for verifying ownership of every element submitted by a customer.

We may refuse content that we reasonably believe is unlawful, infringing, deceptive, hateful, threatening, sexually exploitative or otherwise inappropriate.

The customer remains responsible for claims arising from content the customer supplied or instructed us to reproduce.

9. Artwork Quality

Customers are responsible for providing artwork that is suitable for the selected product and size.

Low-resolution, blurry, compressed, pixelated, incorrectly sized or improperly formatted files may affect the finished product.

We may notify the customer when an obvious artwork issue is discovered, but we cannot guarantee that every issue will be identified before production.

If the customer approves the use of artwork after being warned about a quality concern, the resulting appearance will not ordinarily qualify as a production defect.

10. Graphic Design and Design Ownership

Payment for a printed product does not automatically include ownership or delivery of editable design files, source files, working files, fonts, templates, mockups or production files.

Unless otherwise stated in writing:

• AMESS Creative retains ownership of its working and production files

• Customers receive the completed printed product they purchased

• Source files are not included

• Design concepts that are rejected or not purchased remain the property of AMESS Creative

• Internal production methods, templates and processes remain confidential

When a customer separately purchases a full custom graphic-design or logo package that expressly includes ownership rights, the customer will receive the rights and deliverables stated in that package or written agreement.

Third-party fonts, stock images, templates, software assets and licensed materials remain subject to their original license terms and cannot be transferred beyond those terms.

11. Design Revisions

The number of included revisions depends on the purchased product, design package, subscription or quote.

A revision generally means a reasonable adjustment to the existing design direction. A request for a completely different concept, substantial redesign or work outside the agreed scope may be treated as a new project and charged separately.

Repeated changes, delayed responses or changes after approval may affect the completion date.

12. Artificial Intelligence Content

Some customer-provided or customer-requested artwork may include content created or modified with artificial-intelligence tools.

AI-generated content may involve limitations concerning originality, copyright protection, licensing, accuracy and exclusivity.

Customers who submit or request AI-generated content are responsible for confirming that they have the necessary rights to use it and that the content is appropriate for their intended purpose.

AMESS Creative does not guarantee that AI-generated content will be unique, legally protectable, factually accurate or free from similarities to existing work.

13. Design-Assistance Subscriptions

A design-assistance subscription provides access to the services and benefits described in the applicable subscription plan. It does not provide unlimited ownership of source files or unlimited work unless expressly stated.

Unless a plan specifically offers a pause option, subscriptions cannot be paused. Canceling a subscription ends access to the subscription benefits at the end of the applicable paid period.

Customers who cancel and later rejoin must enroll at the price and under the terms available at that time. Previous subscription pricing is not guaranteed.

Subscription access may not be activated solely to obtain discounted design work and then immediately canceled in a manner that abuses the program.

We may limit or terminate subscription access for:

• Nonpayment

• Fraudulent activity

• Harassment or abusive conduct

• Excessive or unreasonable use

• Sharing subscription access with unauthorized parties

• Repeated policy violations

• Use outside the subscription’s stated purpose

Any material changes to a recurring subscription price or service will be communicated as required by applicable law.

14. Production and Turnaround Times

Production time begins only after all applicable requirements have been completed, including:

• Payment

• Submission of usable artwork

• Submission of required order information

• Final proof approval

• Resolution of outstanding questions

Production estimates are not guaranteed completion dates unless AMESS Creative expressly provides a written guaranteed deadline.

Turnaround may be affected by revisions, customer response times, order complexity, quantity, material availability, equipment issues, weather, holidays and circumstances outside our reasonable control.

Rush production must be approved before the order is placed and may require an additional fee.

Expedited shipping does not shorten production time.

15. Shipping and Delivery

Shipping is governed by our separate Shipping Policy, which is incorporated into these Terms.

Delivery estimates provided by carriers are estimates and begin after production is complete and the package has been accepted by the carrier.

Customers are responsible for providing a complete and accurate shipping address.

AMESS Creative will provide reasonable assistance with carrier investigations and shipping claims when appropriate, but we cannot control carrier operations, weather delays, customs processing or other events outside our control.

16. Local Pickup

Eligible orders may be collected from our Tallahassee pickup location after the customer receives confirmation that the order is ready.

Customers should not arrive before receiving a ready-for-pickup notification.

Orders must be collected during available pickup hours. We may request an order confirmation or identification before releasing an order.

17. Cancellations, Returns, Reprints and Refunds

Cancellations, returns, exchanges, reprints, credits and refunds are governed by our separate Refund Policy, which is incorporated into these Terms.

Because custom products are produced specifically for each customer, they generally cannot be returned or exchanged because of a change of mind, an incorrect customer selection or an error visible in an approved proof.

This does not prevent AMESS Creative from addressing verified production defects, damage, incorrect items or other circumstances covered by our Refund Policy or applicable law.

18. Color, Material and Production Variations

Exact color matching is not guaranteed unless a specific color-matching service is expressly included in writing.

Colors may vary because of:

• Screen calibration

• Lighting conditions

• Material color and texture

• Ink type

• Printer and production method

• Lamination or coating

• Changes between production runs

Minor variations in color, cutting, placement, dimensions, finish and quantity may occur during custom production and are not necessarily defects.

19. Customer Measurements and Installation

Customers are responsible for confirming measurements, surfaces, placement areas and installation requirements unless professional measurement or installation is included in the order.

AMESS Creative is not responsible for problems caused by incorrect measurements supplied by the customer or by installation performed by the customer or an unaffiliated third party.

Surface condition, temperature, moisture, cleaning products, paint quality, texture and installation technique may affect adhesive products and graphics.

20. Promotions and Discount Codes

Promotions and discount codes:

• May be limited to certain products or customers

• May have expiration dates

• May not be combined unless expressly permitted

• Have no cash value

• Cannot ordinarily be applied after an order is placed

• May be canceled or corrected if issued or displayed in error

We reserve the right to reject suspected misuse, duplication, manipulation or fraudulent use of promotional offers.

21. Prohibited Website Use

You may not use our website or services to:

• Violate any law

• Infringe intellectual-property rights

• Submit false or misleading information

• Transmit malware or harmful code

• Attempt unauthorized access to the website

• Interfere with website security or operation

• Scrape or copy website content without permission

• Impersonate another person or business

• Commit fraud or payment abuse

• Harass or threaten employees, contractors or customers

We may suspend or block access when necessary to protect the business, website or other customers.

22. Respectful Conduct and Right to Refuse Service

AMESS Creative is committed to maintaining respectful and professional customer relationships.

We reserve the right to refuse or discontinue service in situations involving:

• Harassment, threats or abusive conduct

• Fraud or attempted fraud

• Unlawful requests

• Repeated policy violations

• Unauthorized chargebacks or payment disputes

• Failure to provide required information

• Conduct that creates a safety or security concern

When appropriate, any refund will be determined according to the work already completed, materials purchased, products produced and applicable law.

23. Website Availability and Third-Party Services

Our website may rely on third-party services, including Shopify, payment processors, shipping carriers, form providers, review platforms and social-media services.

We do not guarantee that the website or every third-party service will be uninterrupted, error-free or continuously available.

Links to third-party websites are provided for convenience. AMESS Creative does not control and is not responsible for the content, security or policies of unaffiliated websites.

24. Errors and Corrections

Occasionally, the website may contain typographical errors, incorrect prices, inaccurate product information or outdated availability.

We reserve the right to correct errors and update information.

If an obvious error materially affects an order that has already been submitted, we will contact the customer to provide available options, which may include correcting the order, paying an adjusted price or canceling the affected portion for a refund.

25. Disclaimer of Warranties

To the extent permitted by law, products and services are provided according to the specifications stated in the order, quote and approved proof.

AMESS Creative does not guarantee that every product will be suitable for every customer’s intended application, surface, environment or business purpose unless that suitability is expressly confirmed in writing.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

26. Limitation of Liability

To the extent permitted by law, AMESS Creative will not be liable for indirect, incidental, special or consequential losses arising from an order, including lost profits, lost business, missed events or damage resulting from delays outside our reasonable control.

For a valid claim directly related to a product or service, our responsibility will generally be limited to the amount paid for the affected product or service, or an appropriate repair, replacement, reprint, credit or refund.

These limitations do not apply where liability cannot legally be limited.

27. Indemnification

You agree to be responsible for reasonable claims, losses or expenses resulting from:

• Content or artwork you submitted

• Your violation of these Terms

• Your infringement of another party’s rights

• Your unlawful or unauthorized use of our products or services

This section does not require you to accept responsibility for conduct caused solely by AMESS Creative.

28. Payment Disputes

Customers should contact AMESS Creative promptly regarding billing, production, shipping or order concerns so we have a reasonable opportunity to investigate and resolve the issue.

Submitting a knowingly false payment dispute, claiming an authorized transaction was unauthorized or retaining completed custom products after receiving an improper reversal may be considered payment fraud.

Nothing in this section limits a customer’s lawful right to dispute an unauthorized or genuinely unresolved transaction.

29. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to applicable consumer rights and jurisdictional requirements, disputes relating to these Terms or an AMESS Creative order will be handled in an appropriate court located in Leon County, Florida.

Before filing a formal claim, both parties are encouraged to make a reasonable good-faith effort to resolve the matter directly.

30. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

An unenforceable provision will be interpreted or limited only to the extent necessary to make it enforceable where permitted.

31. No Waiver

A failure by AMESS Creative to enforce a provision of these Terms does not waive our right to enforce it later.

32. Changes to These Terms

We may update these Terms periodically to reflect changes in our products, services, business practices or legal requirements.

The updated version will be posted on this page with a revised “Last updated” date.

Changes will apply to website use and orders placed after the updated Terms are posted unless otherwise required by law.

33. Entire Agreement

These Terms, together with the applicable order, quote, invoice, approved proof, Shipping Policy, Refund Policy and Privacy Policy, form the agreement between the customer and AMESS Creative regarding the applicable purchase.

If a written custom quote or contract expressly conflicts with these general Terms, the specifically negotiated written terms will control for that project.
